Nigeria’s Judiciary Staff Union, Governors on War Path Over Executive Order 10

… Insists on Judiciary Autonomy

The Judiciary Staff Union of Nigeria (JUSUN) on Monday said the union is ready to battle the Governors again in court for their opposition to the executive order 10 signed by President Buhari on Friday.

Reports have it that Governors are threatening to challenge president Buhari in court over executive order 10 granting autonomy for state Judiciary and assemblies in the country.

Reacting to position of the Governors, National President of JUSUN Comrade Marwan Mustapha Adamu said it is sad for the Governors to opposed president Buhari for signing the order.

He said the Governors who some are the direct beneficiaries of various Court judgements, are the ones choosing which Court ruling to respect.

Comrade Mustapha recalled that the Governors didn’t comply nor appeal the judgement when the union went to court for interpretation of sections 121(3) and other relevant sections on Judiciary autonomy and got judgement in her favour in 2014.

He said the union believes that there is no going back on financial autonomy for Judiciary, adding that “we won’t rest unless that is actualise.

“Let me use this opportunity to inform the Governors that JUSUN is ready to meet with them in court. They can’t always have there ways . The autonomy for the Judiciary as a third arm of government has come to stay, so there is no going back on that.

“Sections 121(3) of the Constitution of the Federal Republic of Nigeria, 1999 (as Amended); and all other applicable laws, instruments, conventions and regulations, which provides for financial autonomy at the state arm of government is very clear, so anything less than that would be resisted by the union.

“The Governors also need to be reminded that the union had in 2014 gotten a judgement in favour of financial autonomy for Judiciary and non of them is complying nor appeal that ruling”.
